2. Scope and Purpose

These Terms and Conditions govern the purchase of products and services offered through this website, including:

• Physical products: miniatures and model figures

• Digital products: downloadable STL files

• Services: digital sculpting and 3D modeling commissions

All products are intended for painting, collecting, tabletop gaming and wargaming  purposes.

3. Product Characteristics

• All physical miniatures are supplied unassembled and unpainted

• They may require assembly, handling, and technical skill

• They may contain small parts and are not suitable for children

Digital products (STL files) are provided for 3D printing and require appropriate hardware/software for use.

4. Purchase Process

The purchase process follows the standard WooCommerce checkout system:

1. Product selection

2. Cart review

3. Billing and shipping details

4. Payment method selection

5. Order confirmation

Once completed, the customer will receive an order confirmation email.

5. Pricing and Taxes

• All prices are displayed in euros (€)

• Prices include applicable taxes (VAT), unless stated otherwise

• Shipping costs are calculated and displayed before checkout completion

For international orders, additional customs duties or import taxes may apply, which are the responsibility of the customer.

6. Payment Methods

We accept the following payment methods:

• Credit / Debit Card

• PayPal

• Bank Transfer

Orders will only be processed once payment has been confirmed. For bank transfers, processing begins once funds are received.

7. Shipping (Physical Products)

• We ship internationally

• Shipments are handled through Correos or equivalent logistics operators and may also be carried out via private courier companies, depending on availability and service requirements

• Delivery times are estimated and may vary depending on destination

The seller is not responsible for delays caused by carriers, customs, or external circumstances beyond their control.

8. Delivery of Digital Products

Digital products (STL files) are delivered electronically after payment confirmation via download link or customer account access.

9. Right of Withdrawal (EU Consumers)

9.1 Physical Products (Standard and Limited Editions)

Customers have the right to withdraw from the purchase within 14 calendar days from the date of receipt of the goods, without giving any reason.

This right applies to both standard products and limited edition items, provided that they are pre-manufactured and not custom-made for the customer.

To exercise this right, the customer must notify their decision via email to: order@gorgonmodels.com

Returned items must be unused, in their original condition and in their original packaging.

9.2 Exceptions to the Right of Withdrawal

The right of withdrawal does not apply in the following cases:

• Products that are made to order or clearly personalized according to the customer’s specifications

• Digital content once the download or access has begun, with the customer’s express consent and acknowledgment of loss of withdrawal rights (see section 9.3)

9.3 Digital Products (STL Files)

In accordance with applicable EU consumer protection law, the right of withdrawal does not apply to digital content not supplied on a tangible medium once the performance has begun.

By purchasing and downloading STL files, the customer:

• Gives express consent for the immediate supply of digital content

• Acknowledges that they lose their right of withdrawal once the download begins

9.4 Returns and Refunds

• Physical products: returns are accepted within the legal withdrawal period (14 days)

• Returned items must be in unused condition and properly packaged

• Return shipping costs are borne by the customer, unless the product is defective or incorrect

For digital products, refunds are only issued in the case of defective files or errors attributable to the seller.

10. Returns and Refunds

• Physical products:

  • Returns are accepted within the legal withdrawal period

  • Items must be unused and in original packaging

  • Return shipping costs are borne by the customer unless the item is defective or incorrect

• Digital products:

  • No refunds are available once files have been downloaded

  • Refunds are only issued in case of defective files or seller error

11. Pre-Orders

Some products may be available as pre-orders:

• These are products not yet ready for immediate shipment

• Estimated delivery dates may change

• By placing a pre-order, the customer accepts these conditions

If cancelled before dispatch, a full refund will be issued using the original payment method.

12. Digital Sculpting Services

The website may offer digital sculpting and 3D modeling services on a commission basis.

All terms (price, deadlines, revisions, delivery, and usage rights) are agreed individually between the customer and the service provider.

13. Intellectual Property

All digital files (STL) and 3D designs remain the intellectual property of the owner or licensors.

• A personal-use license is granted only

• Redistribution, resale, or sharing is strictly prohibited

• Commercial use is not allowed without explicit written permission

14. Warranty

All products are covered by applicable legal warranties.

In case of defective or damaged items, the customer must notify the seller within 48 hours of receipt, providing photos of the damage + packaging.

15. Liability

The seller is not responsible for:

• Improper use of products

• Incorrect assembly or handling

• Delays caused by external parties

• Misuse of digital files

16. Data Protection

Personal data is processed in accordance with the website’s Privacy Policy.

17. Governing Law

These Terms are governed by Spanish law.

Any disputes shall be submitted to the courts in accordance with applicable legislation.
